NSBO RULES AND REGULATIONS

Amended Fall, 2008

 

Article 1          Name of the Association
1.1       The name of NSBO may only be changed through constitutional process

Article 2          Membership in NSBO

2.1       New officials and members renewing their membership must have all their requirements verified by the Area Supervisor each year during the registration period.

2.2       Members not qualifying as ³in good standing² past the registration deadline (the provincial date for writing the FIBA exam) shall not be assigned games in any area under NSBO jurisdiction.

2.3       Members who act in such a manner as to bring the reputation of NSBO into disrepute or bring the reputation of the game of basketball into disrepute must be dealt with by the executive in accordance to the protocol laid out in the constitution under sections 2.0 - 2.4. 

2.4       Members may appeal sanctions by NSBO to the Provincial Sports Governing Body (BNS).

2.5       Members are considered (for NSBO administration purposes) to be members of the Area in which they reside and are required to register with the Area Supervisor in that area. Area Supervisors shall keep a ³hard copy file² on members in their area. Officials may choose to become members in more than one area but are then subject to area rates in both areas.

2.6 All executive and standing committee members of NSBO must be members in good standing. If one of these executive or committee members lets their membership lapse the president may remove them from that position or committee immediately. The president may reinstate the status of a committee or executive member if they become members in good standing but only within 14 days of the lapse of their membership. Past the 14-day mark the member will be permanently replaced on the executive or committee.

2.7.1 NSBO Executive members who are unable to actively officiate but wish to continue in their executive position may be granted membership in good standing but membership fees shall be waived.

2.7.2         NSBO officials shall not referee any games unless assigned by the Area Assignor. The Area Supervisor must review any additional games/tournaments/summer leagues.

2.7.3    NSBO members shall not be assigned games that:

- Involve immediate family members.
- Involve high schools, colleges, or universities for which he/she is an employee.
- In which his/her area supervisor believes NSBO’s impartiality could be questioned 

Article 3          Meetings of NSBO

3.1 The general meeting of NSBO shall be held in the following locations for the dates designated in this regulation. The specific location of the meeting shall be determined by the local area supervisor and communicated to the President 30-dayss prior to the meeting date. 

Spring 2009 – Valley
Spring 2010 – Halifax
Spring 2011- Truro
Spring 2012 - Valley

3.2       Minutes of the annual general and executive meetings will be posted on the NSBO web site one month prior to the meeting. The minutes will be for information purposes of the general membership.

Article 4          Executive Positions/Standing Committees

4.1 Expectations of NSBO Executive/Standing Committee Members

4.1.1 NSBO Executive or Committee members who have been sanctioned by NSBO, BNS, CABO, or any other association recognized by NSBO will be removed from their executive position and a replacement named by the President for the remainder of the term for that position.

4.1.2         A member appointed by the President will replace NSBO Executive or Committee members who resign for the remainder of their term.

4.1.3         NSBO Executive or Committee members may be removed from their positions by a three quarter (3/4) majority vote of the executive at an executive or special meeting with a quorum.

4.2               Standing Committees of NSBO

4.2.1    AUS Selection Committee

4.2.1.1 This committee has the responsibility to assess, discuss and chose to a maximum of 28-officials, those members of Level II or greater that will work games in the AUS men’s and women’s leagues. This committee will be responsible for providing NSBO with a list of officials at the end of each season.  

4.2.1.2   AUS board shall consist of a maximum of 28 members.

4.2.1.3   All NSBO members of a Level II or greater and not on the AUS panel are encouraged to apply in writing to the chair of the AUS selection committee for panel consideration. The Chair must receive applications no later than June 1 for the next season. The committee members will review the candidates and candidates may be assigned to positions on the AUS OfficialsΉ List. Applications should include all pertinent information from the individualΉs officiating history.

4.2.1.4   Notification of the AUS membersΉ list shall be completed no later than the date of the Spring NSBO General Meeting.

4.2.1.5   Completion of the assessment of the AUS candidates for inclusion in the upcoming season will take place no later than September 15 following the date of the Spring NSBO General Meeting.

4.2.1.6   All members included in the selection process shall be informed of the result of the process no later than September 30 following the date of the Spring NSBO General Meeting. All applicants must be notified of their inclusion or exclusion from the AUS panel.

4.2.1.7   Members included on the AUS list are required to attend the mandatory Level II clinic in the fall prior to the start of the season. AUS Officials who do not complete this requirement shall be subject to a reduced schedule in that season. The commissioners shall determine the reduction in that schedule.

4.2.1.8 NSBO members shall not referee back-to-back CIS games unless special circumstances warrant their assignment.

4.2.1.9 AUS menΉs and womenΉs panel commissioners may assign any level 2 official to a game under special circumstances should the need arise.

4.2.1.10 Any member of the AUS Panel has the right to apply for and be granted a leave of absence for one season or part thereof. The AUS Selection Committee shall treat a member who applies for more than one leave of absence in a row or reapplies after resigning as a new applicant.

4.2.1.11 The AUS board is governed by the NSBO Constitution, the NSBO Rules and Regulations and the NSBO-AUS/NS contract.

4.2.2     National Selection Committee

4.2.2.1 The National Selection Committee will meet when CABO informs NSBO that there are to be assignments to National Tournaments for NSBO members.

The dates for submission of these candidates to CABO are of utmost importance and the meeting of the Selection Committee must give a substantial amount of lead-time for the assignment of NSBO members to these tournaments. There is substantial lead-time required by members and CABO to make arrangements for travel, to accept/reject assignments and to communicate with host organizing committees.

 4.2.2.2   Members must be in good standing to receive CABO assignments.

4.2.2.3   NSBO Members who receive CABO National Appointments will not be responsible for travel expenses.

4.2.2.4   In choosing candidates for CIS National Championships, the National Selection Committee shall use Level 2 ranking information as a major criterion. Because the ranking information will reflect the previous yearΉs performance the Committee must also consider the current yearΉs performance in making their final selections.

4.2.2.5   National Selection Committee members wishing to be considered for a particular appointment shall remove themselves from the Committee and the President shall appoint a replacement. 

4.2.3     NSSAF Tournament Selection Committee

4.2.3.1   NSBO members are required to apply through their Area Supervisors in writing to the Chair of this committee by January 30 of each year.

4.2.3.2   NSBO members considering assignment to Division 1 Tournaments must have passed their FIBA test (86 per cent minimum mark within the past two seasons) to be considered for an NSSAF tournament and have worked at least four games at the level they are being considered for in that season.

4.2.3.3   The NSSAF Tournament Selection Committee will meet as required to assess the applications/recommendations for assignments to the NSSAF Tournaments. These assignments will be communicated to the members as quickly as possible for final confirmation.

4.2.3.4 Members who turn down assignments without legitimate reason shall not be considered for assignment in the next year.

4.2.4     Discipline Committee

4.2.4.1 The discipline committee meets to assess complaints regarding any reported incidents involving physical abuse by NSBO members or misconduct above that already administered by the Area Supervisor. The committee will also investigate an unacceptable game performance which may result in a protest of a game being upheld. They will consider all the information in the file and render a decision based on this information regarding any sanctions against the member based on the NSBO Code of Conduct. The member has the right to appear before the discipline committee to speak to the incident. A decision will be communicated in writing to the member immediately after the committee renders the decision. The Area Supervisor, Area Assignor and the Executive of NSBO will also be immediately informed in writing.   

4.2.4.2  Members may appeal the decision of the Discipline Committee by requesting an appeal in writing to the Executive Director of BNS. This request must outline the basis for the appeal. Any appeals of a decision by the Area Supervisor must go through the Discipline Committee.

4.2.4.3  All decisions rendered by BNS in an appeal process are final and binding.

4.2.4.4  NSBO MembersΉ disciplinary files are to be cleared after two.

4.2.4.5  NSBO members who act in such a manner as to bring the reputation of NSBO into disrepute or bring the reputation of the game of basketball into disrepute must be dealt with by the executive in accordance with the NSBO Code of Conduct and NSBO Constitution.

4.2.4.6   Members of NSBO found to have committed physical abuse or misconduct above that already administered by the Area Supervisor are subject to a minimum mandatory three month suspension.

4.2.4.7 Area supervisors, after consultation with the area executive members, are responsible for determining whether a particular situation is to be referred to the discipline committee of NSBO. In cases of chronic, and relatively minor misbehavior (i.e. lateness, missing meeting, harassing assignors etc.) the area supervisor must be willing and able to demonstrate that he/she has utilized some combination of verbal and/or written corrective action before referral to discipline committee. Area supervisors may, after some combination of verbal/written action, mandate a change in either the number or level of assignments an NSBO member receives. Such a change in assignments must be made in writing to the affected member and a copy sent to the vice-president of NSBO.

4.2.5     Rates Committee

4.2.5.1   The Rates Committee will meet when required to work with clients to set rates for the officiating services for NSBO. These rates are considered to be maximum rates that can be charged by NSBO.

4.2.5.2   The Committee must set rates for all levels of basketball played in Nova Scotia except AUS and ACAA games which have a separate contract \ Letter of Agreement.

4.2.5.3   The Committee must publish a ³Rate Sheet² for the members of NSBO to approve at any general meeting of NSBO. The rates must be approved at the general meeting before they can be charged to clients of NSBO. If the rates sheet is not approved the approved rates from the previous agreement will be the approved rate for the balance of the season.

4.2.5.4   Rates are to be set for the following levels of basketball :

4.2.6     Awards Committee

 4.2.6.1

 The Awards Committee shall review the membership information each year to determine which of the NSBO members will be nominated for the following awards after meeting the criteria listed for each specific category:

 NOTE - Only persons who meet the criteria set out below for each award will be considered. Those being considered must have demonstrated a long-term commitment to basketball officiating and also in doing so have brought distinction to NSBO as well as the sport of basketball.

 Recognition MAY take the forms of life memberships, plaques, certificates, and nomination for other awards such as the Nova Scotia Sports Hall of Fame.

 Service Awards

  1. 5, 10, or 15-year service award – Certificate

For all members who have 5,10 or 15 years of (consecutive) service to NSBO.

These will be presented at the local level in each area by the supervisior.

Service Awards

 2. 20 year service award - Certificate

 For all members who have 20-years of (consecutive) service to NSBO. These will be presented at the fall meeting of NSBO by the chair of the awards committee Service Awards

3. 25-Year Service award - Plaque  For all members who have 25-years of (consecutive) service to NSBO. These will be presented at the fall meeting of NSBO by the chair of the awards committee Service Awards

4. Lifetime membership of NSBO award - Plaque  For all members who have a minimum of 30-years of (consecutive) service to NSBO. To receive a lifetime membership the committee must determine the official has been a person who has played a major role in officiating, both on the court and at the board level. A maximum of two persons will be nominated for this distinction per season. These will be announced at the fall meeting of NSBO by the chair of the awards committee. A presentation of this award will be done at a high-level activity. The person (s) receiving this distinction will also be exempt from annual fees for NSBO.

 5. Wink Willox Award

 NOTE: One award per season MAY be handed out in each province  Criteria - Good floor official by local standards  Significant length of service  Varied forms of service  Played key administrative role

 6. Ted Early Award

 NOTE: A single Ted Early award is given out nationally in any one calendar year

 Criteria: Nominee is recognized as a superior floor official  Significant length of service  Varied forms of national and international level service  Administrative leadership role  Interpretive educative role

 7. Frank Baldwin Award

 This award is named after Frank Baldwin who demonstrated an extraordinary commitment to basketball and its grass roots development.

 This award will be given to an official who has contributed significantly to the development of officiating.

 Criteria:

 - Demonstrated a commitment to the development of basketball officials;

 - Demonstrated a commitment to basketball (i.e. coach, player, etc.);

 - Served in an executive or administrative capacity and must have supported the initiatives and goals of NSBO in such a way as to make the contributions worthy of special recognition;

 - Considered to be a good floor official by local standards;

 - Performed a significant length of service;

 - Involved in grass roots programming.

 8. Rod Shoveller Award

 This award is named after Rod Shoveller, an outstanding basketball official who exemplified commitment, floor presence, a no-nonsense attitude, and made a significant contribution to the growth of officiating in Nova Scotia.

Criteria:

 - A young official who demonstrates tremendous potential for growth in officiating;

 - Must be a member in good standing with NSBO;

 - Must achieve the minimal requirements for pre-level 1 officials as identified in the Certification Program; and

 - Must demonstrate commitment, integrity, professionalism and enthusiasm towards the game of basketball.

 9. Sport Nova Scotia Official of the Year nomination (IKON Official of the

Year)

 The IKON Official of the Year (and The Provincial Sport Organizations IKON Official of the Year) will be honored at the IKON Sport Awards

Background

 * This award is presented annually to Nova Scotia's premiere official. This individual demonstrates dedication to leadership, contributions to local sport development, and is seen as an advocate for fair play and ethical behavior in the sport.

 * Anyone may submit a nomination for this award. However, the President of the Provincial Sport Organization must endorse it.

 * A PSO's Official of the year award winner, and all other nominees, will automatically be in the running for the overall Nova Scotia IKON Official of the Year award.

 Eligibility & Selection Criteria

 * The nominee must be considered "normally" a resident of Nova Scotia who has developed as a result of the Nova Scotia Sport System.

 * Both paid and unpaid officials are eligible for this award.

 * Nomination should be based upon accomplishments between April 1st -March 31st of the nominating year.

 The Selection Committee makes its decision based solely upon the information you provide. Please assist them by ensuring that the nomination is accurate, succinct and as complete as possible.

 Recognition: Awards are given to each Provincial Sport Organization IKON Official of the Year, the overall winner of the Nova Scotia IKON Official of the Year as well as the two runners up. All will be honored at the IKON Sport Awards.

10. Nomination to Nova Scotia Sports Hall of Fame

This nomination will be done to further preserve the history of sport in Nova Scotia by recognizing those individuals who have attained the highest standard of achievement as an official recognizes.

 To be nominated, a complete profile of information should be compiled on the individual as well as photographs and memorabilia that may assist the selection committee.

 The candidate must be retired from officiating for a period of three seasons to be considered.

 The induction will take place at the Annual Induction Awards Night with the time and site to be determined by the NS Sports Hall of Fame directors.

 Each nomination will stand for a period of three years without re-nomination


 
11. Nicurity/Ritchie Scholarship

 CABO gives out four $500-scholarships per year. These are available to high school graduates who are enrolled in a post-secondary institution while maintaining an active role as a certified basketball official.

 The scholarships were created to honor Bill Ritchie of New Brunswick and Bryan Nicurity of Saskatchewan, both of whom are past Presidents of CABO and both Ted Earley Award recipients. Both Bryan and Bill are honored members of the Canadian Basketball Hall of Fame.


 
This award goes to a student official who meets the following criteria:

 - Must be a registered member of a provincial officials association as well as CABO.

 - Available to both male and female applicants

 - Financial need is not a factor. A letter must accompany the nomination saying the applicant is a member in good standing

 - Produce a student identification card certifying the applicant is a full time student at a University, College of CEGEP. Students entered in trade, apprenticeship or upgrading programs are eligible but must verify full-time status.

 - Can hold other scholarships or bursaries in conjunction with CABO scholarship

 - Application must be received by June 30 of the year applying for the bursary.

 Winners will be announced at the CABO AGM in September each year.


 
12. CABO CAMP FUNDING

CABO has determined each province to be eligible for one scholarship, valued at approximately $500 to be used for professional development.

 To be eligible, the official must apply in writing to the Awards Committee, NSBO. It is imperative the applicant is a member in good standing with their local board and be in a position to gain knowledge and use mechanics and fundamentals of three-person officiating.

 Applicants will be reviewed by the awards committee and a decision on who will most benefit from attending the camp will be chosen and announced at the Spring AGM.


 
4.2.6.2 The committee must inform the executive of their findings regarding the awards and the nominations

  

 4.2.6.3 The committee chair shall purchase awards suitable for presentation to the award winners and charge the costs back to the treasurer of NSBO.

These purchases must fall within the guidelines of the NSBO budget.

4.2.6.4 If an area deems awards necessary or appropriate for one of their officials, current or past, the award is the responsibility of the area and it's members and should be co-ordinated through the area supervisor.

4.2.7         Financial Committee

4.2.7.1 The financial committee is responsible for generating revenue-producing initiatives on behalf of NSBO.

4.2.8         AUS Tournament Selection Committee

4.2.8.1 The AUS Tournament Selection Committee is responsible for selecting NSBO representatives to the AUS Championships (Men/Women).

4.2.8.2 The committee must consider both the previous year’s AUS performance as well as officials’ performance in the current year when making its selection.

4.2.8.3   In the case that a member of the committee wishes to be considered as a potential candidate he/she must remove him/herself from the committee and the President shall select a replacement.

4.2.9         Professional Development Committee

4.2.9.1 The funding formula to be used with respect to allocation of the PD funds will be the following:

1-      60% - to support province wide initiatives

2-      40% - to support individual initiatives

4.2.9.2   One-half (1\2) of operating surpluses will be allocated to PD fund on an annual basis. Ann annual amount of $1,500 will be made available to the PD fund through memberships fees

4.2.9.3 The mandate of the PD committee is:

a-       To distribute PD funds

b-      To oversee fund raising initiatives

c-       To present PD report at spring AGM with respect to fund activities.

4.2.9.3  PD fund will be managed under the office of the treasurer in concert with the president and a third member chosen at the discretion of the chair.

 4.3        Non-Executive Positions within NSBO

Selected by the NSBO executive.

4.3.1     Webmaster: Responsible for maintaining the official NSBO website.

The NSBO Webmaster will post or delete information on the website only after consultation with and approval from the President, Vice President, Provincial Supervisor, Provincial Interpreter or Secretary \ Treasurer.

Article 5          Rules and Regulations

5.1               NSBO members are expected to abide by the Rules and Regulations as contained in this document.

Article 6          Dress Regulations

6.1 Both the FIBA grey and the black and white striped jersey are acceptable uniforms for NSBO officials. The striped jersey may only be worn during AUS or ACAA competition.

Article 7          Certification

7.1       All NSBO members are designated at a level of certification outlined in the constitution. The member is designated at the level of certification based on the completion of the criteria outlined in the sections 7.0 of the NSBO Constitution. 

7.2       Any member who disagrees with their designation may appeal to the Provincial Assessor to review their file. The finding of the Provincial Supervisor shall be communicated to the member, their Area Supervisor and Area Assignor in writing. The finding of the Provincial Assessor and the designation assigned to the member shall be final and no appeal of this finding is available to the member.

7.3       Members receive payment and clients are charged for service based on the memberΉs level of certification. The Rate Sheet, negotiated by the Rates Committee and approved by the membership, details the rates for NSBO members.

Article 8          Financial

8.1       Budget lines that must be included in the financial report shall include:

8.2.1        The yearly-approved NSBO Budget must be a balanced budget. No membership may approve a budget submission that is based on a deficit.

8.2.2        Area Supervisor will be responsible to ensure that financial information on the local area is reported to that area in a manner acceptable by all members. (Clarification: Supervisor is responsible to ensure this happens but; not necessarily that they prepare report.)

 Article 9          Amending the Constitution

The constitution may only be amended by two-third majority vote of the members present at a general meeting in which a constitutional motion has been brought to the floor. If a special meeting is called all members must be given written notice 15 days prior to the meeting. Amendments can be made at any meetings of NSBO which meet the criteria listed above.

Appendix 1 - Certification of Officials

The Officiating Certification Program of the Nova Scotia Basketball Officials

October 1999(updated October 2001)

 

This Certification Program of the Nova Scotia Basketball Officials is to assist in the uniform and consistent education and development of basketball officials in the province.  This program promotes an accessible and attainable goal for all officials in the province.

 

The Certification Program will consist of four levels with Level IV representing the highest ranking.  To qualify for certification, the prospective candidate must be a member of good standing of the N.S.B.O. and shall complete all requirements of one level before advancing to the next level.  The candidate must be approved by the Provincial Evaluator before advancing to the next level.   For the purpose of this program an officiating year will be from September 1st to August 31st.

 

The standards of the Certification Program are based on performance and focus on the following criteria:

 

·       provincial exam results

·       local and regional game performance evaluations

·       N.S.B.O. clinic participation

·       progressive proficiency at higher levels of competition

 

The candidate shall be responsible for maintaining all personal officiating records.  N.S.B.O. uniform is the approved standard of dress.

 

PRE-LEVEL I

 

This is the introductory level to officiating.  The candidate must achieve the minimal requirements for membership as provided by the Associations’ by-laws.

 

Area supervisors shall provide pre-level one packages as adopted by national certification program.

 

Requirements

 

-        The candidate must attend a pre-level I Rules/Mechanics Clinic as provided or approved by the N.S.B.O. and conducted by the local area supervisor or delegate(s).

 

-        The candidate must obtain a mark of at least 70 % in the approved written provincial exam in the same year as applying as well as receive a floor evaluation by the regional evaluator.

 

-        The candidate must have at least one year of experience and have officiated at least 50 games.

 

-        The candidate must have been evaluated by a Provincial Regional Evaluator or approved delegate in not less than two Class V (or higher) level games and recommended for this level and approved by the Area Supervisor.

 

LEVEL I

 

Prerequisite

 

-        The candidate must have successfully achieved the Pre-Level I Certification requirements of the N.S.B.O.

 

Requirements

 

-        The candidate must complete the National Officials Certification Program, Level 1.

 

-        The candidate must have at least two consecutive years and have officiated at least 100 games, including a minimum of 25 Class IV games.

 

-        The candidate must obtain a mark of at least 86 % in the approved written provincial exam in the same year as applying.

 

-         The candidate must have been evaluated by a Provincial Regional Evaluator or approved delegate in not less than two Class IV (or higher) level games and recommended for this level and approved by the Area supervisor.

LEVEL II

 

Prerequisite

 

-        The candidate must have successfully achieved the LEVEL I Certification requirement of the N.S.B.O.

 

Requirements

 

-        The candidate must complete the National Officials Certification Program - Level II.

 

-        The candidate must have at least four years experience preceding the year of certification.

 

-        The candidate must obtain a mark of at least 86 % in the approved written provincial exam in the same year as applying.

 

-        The candidate must receive two positive evaluations for this level from a Provincial Regional Evaluator to be considered for advancement to the next level.

 

The above noted evaluations must be received from any of the following tournaments (one of which must be at a Divisional I NSSAF Provincial Championship or equivalent).  These two evaluations cannot be received in the same officiating seasons.  Note: officiating season will be from September 15th  to March 31st.

 

-       Division I - Regional Qualifying Tournaments

-       Division I  - NSSAF Provincial Championships;

-       Atlantic College Athletic Association Championship;

-       Championship tournaments approved by members of the Executive (President, Provincial Evaluator, Provincial Supervisor).

       

Note:  The  candidate must apply in writing to the Provincial Evaluator for advancement to Level II.  No official will advance to this level without the approval of the Provincial Evaluator.

 

LEVEL III

 

Prerequisite

 

-        The candidate must have successfully achieved the LEVEL II Certification requirements of the N.S.B.O.

 

Requirements

 

-        The candidate must complete the National Officials Certification Program - Level III and attain Level 1 of Technical of National Coaching Certification Program.

 

-        The candidate must have prepared and conducted a Basketball Official’s Clinic approved by the N.S.B.O.

 

-        The candidate must obtain a mark of 86% in the approved written provincial exam in the same year as applying.

 

-         The candidate must have received two favorable evaluations from a CABO National Evaluator at any of the CABO assigned national championships.

 

          

LEVEL IV

 

Prerequisite

 

-        The candidate must have successfully achieved the LEVEL III Certification requirements of the N.S.B.O.

 

Requirements

 

-        The candidate must be recommended by the province, approved by BasCan and CABO.

 

-        The candidate must attend and successfully complete the FIBA Certification Clinic Examination:  physical, practical, and written as per FIBA standards and have officiated in international competition.

 

RETROACTIVE CREDIT

To respect the accomplishments of recent NSBO members who have performed in other CABO jurisdictions, credentials earned outside of Nova Scotia may be recognized.  Candidates should apply to the Provincial Supervisor for appropriate recognition.
