Constitution

1.0 Name of the Association
The name of this association is The Nova Scotia Basketball Officials’ herein referred to as NSBO.
2.0 Membership in NSBO
2.1 Full Membership
Full voting membership to NSBO may be granted to persons who have fulfilled all the following criteria:
a) passed an NSBO approved certification course;
b) written the approved Canadian Association of Basketball Officials’ rules exam;
c) paid in full the registration fees associated with membership in NSBO
d) satisfied the area supervisor in the region in which they reside, they are of good character, and membership in NSBO will reflect in a positive manner on the entire membership of NSBO.
Once these criteria have been fulfilled and confirmed in writing, the secretary of NSBO will record the membership of this person and list them as a full member of NSBO.
NOTE - A member in good standing is any member who has fully paid their NSBO dues, has no outstanding discipline sanction ongoing from NSBO, Basketball NS, CABO or any other association recognized by NSBO, or granted member for life status by the Executive.
2.2 Associate Membership
Associate membership may be granted to individuals or associations who wish to be informed and kept up to date on the activities of NSBO. Associate members will be included on mailing lists and have access to NSBO meetings, however are not permitted to address council or vote on issues at any session of the general membership or executive meetings.
2.3 Member for Life
Membership for Life may be granted by special motion at the Spring AGM of NSBO to any individual that the executive deems worthy of such an honour. Membership for Life is granted to members who have demonstrated long serving dedication to NSBO. These individuals will have all rights and privileges of regular NSBO members, however, are exempt from registration fees for life.
2.4 Revocation of Membership
The executive of NSBO may revoke membership of any member with a special motion at an NSBO executive meeting. The length of time a membership may be revoked is to be detailed in the motion (the longest period being life). The decision may only be brought to the general meeting when the executive votes a three-quarter majority at an executive meeting.
2.5 Membership Dues
Members are required to pay, (in full), fees to NSBO each year. These fees are payable, (in full) on the same day the CABO exam is administered. Members not paid (in full) by this day are not certified to receive games from NSBO members acting as assignors. The NSBO fees schedule is outlined in our rules and regulations. Fees are set by contract with participating clients.
3.0 Meetings of NSBO
3.1 General Meetings of NSBO
One General Meeting of NSBO is held in the Spring of each year:
• Spring General Meeting - Last Sunday of May
(or as decided by the Executive)
The executive will decide the location of the meeting on a three-year rotational basis.
Spring Meeting – To be held the last Sunday in May on rotation basis (Truro/Valley/Halifax)
3.2 Executive Meetings of NSBO
Executive meetings of NSBO may be held if required on the same day as the general meetings. The executive meetings precede the general meeting. Other executive meetings of NSBO can be called by the president or by another executive member with the written support of five other executive members. If the member submits this documentation to the president an executive meeting MUST be called and held within 15 working days.
3.3 Special Meetings of NSBO
A special meeting of the general membership of NSBO may be called under exceptional circumstances. The executive must vote a three quarter majority to call such a special meeting. This vote may be conducted and verified by the secretary\treasurer. Special meetings of NSBO will be located in a venue decided by a committee of the president, vice-president and supervisor, in a centralized location

3.5 Meeting Rules
All NSBO meetings will be conducted according to the Robert’s Rules of Order with the chair being held by the President unless the President recognizes another chairperson.
3.6 Quorum
A Quorum at any Executive Meeting shall consist of 50 per cent of the voting executive members. There are no quorum restrictions at General Meetings.
3.7 Fiscal Year
The Fiscal Year of the NSBO shall run from July 1 - June 30.
4.0 Executive Positions/Standing Committees
4.1 The following positions are recognized as executive positions within NSBO:

Secretary/Treasurer/Registrar/Web Master
Provincial Supervisor
Provincial Assessor
Provincial Interpreter
Member at Large
AUS Commissioner
ACAA Commissioner
Area Supervisors
These persons are obliged to attend executive meetings of NSBO. Failure to attend two consecutive meetings of the executive may result in removal from the executive position and an interim appointment by the President to that position of another NSBO member who will hold the position for the remainder of the designated term. The positions are grouped into sections that will be elected in offsetting years, as follows:
Group A - two-year term voted on in years of odd numbers

Group C - Three-year term appointed by executive of NSBO following review of applicants:

Group D - one-year term, elected in local area elections and confirmed at each Spring Meeting:
Area Supervisors
Group E - Three year term, will be announced every three years following election in respective local area starting at the Spring Meeting, 2001. These elections will be held again in 2007, 2010, 2013, 2016, 2019, 2022, etc.
Area Assignors
4.1 Committees
Committees shall be established by the executive, at executive meetings to conduct business and the executive may grant power to the committee to establish temporary regulations. Any temporary regulations shall be governing until they are either accepted or set aside by a vote of the executive at the executive meeting immediately following the establishment of any such temporary regulations. Any committees formed must have the following criteria attached: commencement date, expected completion date, designated chairperson, designated members, identified mandate that will be formally (in writing) be reported on at meetings of NSBO.
4.2 Standing Committees
Standing committees are established by power of this constitution and remain in existence as long as NSBO exists. The following committees and their Chairpersons are such standing committees:
4.2.1 AUS / ACAA Selection Committee - Chairperson, NSBO President, Provincial Assessor, Provincial Supervisor, AUS Men’s and Women’s Commissioner and ACAA Commissioner
4.2.2 National Selection Committee - Chairperson, Provincial Supervisor, AUS Men’s Commissioner, AUS Women’s Commissioner, ACAA commissioner, NSBO president, and Provincial assessor. The committee must consist of six people and should an official wish to be considered for assignment must preclude him/her from the process. The president will appoint a replacement. This Committee will select national officiating appointments as well as determine NSBO candidates for FIBA licensing.
4.2.3 NSSAF Tournament Selection Committee - Chairperson, NSBO President, Provincial Assessor, Provincial supervisor
4.2.4 Discipline Committee: Chairperson, NSBO Vice President, Member at Large, One other Area Supervisor appointed by chair
4.2.5 Rates Committee - Chairperson, Provincial Supervisor, Vice President, one other NSBO member appointed by chair
4.2.6 Awards Committee - Chairperson, NSBO Vice President, Member at Large, one other NSBO member appointed by chair
4.2.7 Financial Committee - Chairperson, Secretary \ Treasurer, Provincial Supervisor, three other NSBO members appointed by chair
4.2.8 AUS Tournament Selection Committee - Chairperson, AUS Assignor of that gender, Provincial Supervisor, ACAA Commissioner, NSBO President, and Provincial Assessor. The committee must consist of six people and should an official wish to be considered for assignment must preclude him/her from the process. The President will appoint a replacement.
4.2.9 Professional Development Committee – Chairperson, Secretary-Treasurer, President, one NSBO member appointed by chair.
5.0 Rules and Regulations
The NSBO Executive has the authority to make rules and regulations concerning the governance of NSBO provided such rules are within the intent of the Constitution. These rules and regulations may be introduced and/or changed at any meeting of the NSBO executive meeting or general membership meeting, and require a majority vote.
6.0 Dress Regulations
NSBO members are required to wear the following uniform when officiating games in Nova Scotia:
• Black Footwear
• Black Socks
• Black Pants
• Black Belt (if worn)
• NSBO Approved Basketball Official’s Shirt
• Black Whistle Lanyard
• Black Whistle
• Approved CABO Jacket
NSBO members are required to conform to CABO dress regulations when officiating in any CABO sanctioned games. The Area Supervisor may use discretion with the requirements for attire of new officials.
7.0 Certification
All members are subject to and governed by the NSBO certification program as outlined in the NSBO Rules and Regulations.
8.0 Financial
8.1 Budget
The treasurer will present a budget to the executive at the fall meeting for the upcoming financial year. The budget must be accepted as presented or the executive may suggest changes. A final budget must be accepted by the executive for implementation in the upcoming fiscal year. The fiscal year for NSBO will be July 1 - June 30.
8.2 Reporting
The treasurer must present a report to the executive at each of the scheduled executive meetings regarding the association budget and financial dealings. The budget will be presented in the fall and finance will be outlined in the spring.
8.3 Banking
The treasurer will open, on behalf of NSBO, an account to transact NSBO business. There shall be three signing authorities on all NSBO accounts including the treasurer, president and one NSBO member selected at the discretion of the treasurer. All cheques will carry the signature of not less than two of the persons authorized on the account.
9.0 Amending the Constitution
The constitution may only be amended by two-third majority vote of the members present at a general meeting in which a constitutional motion has been brought to the floor. If a special meeting is called all members must be given written notice 15 days prior to the meeting. Amendments can be made at any meetings of NSBO which meet the criteria listed above.
